<p>羅明村，1997年時擔任台北縣新莊分局刑事組的組長，原是警界風雲人物，一起槍擊案衍生的收賄官司卻讓他的人生全改變──法院認定他收受黑道50萬元的賄款，包庇犯下槍擊案的真兇，而讓一位少年頂罪。羅明村的案件有諸多問題：欠缺物證；調查站誘導、威脅、利誘證人；指認瑕疵；採認有問題的測謊報告等。甚至，法院認定羅明村與行賄者見面的時間，他提出的不在場證明，不但有警局的會議記錄簽到，還有領槍紀錄，最後事實審法院卻說即使有警察局公務會議簽到紀錄，羅明村還是可能偷溜出去。</p>
<p>由於不在場證明明確，更一審判決羅明村無罪，而且檢察官超過10日法定期間才提出上訴，依法應該無罪定讞。但是最高法院沒有發現上訴逾期，錯誤地將案件發回更審，導致羅明村更二審被判決13年有期徒刑確定。司改會義務律師團曾聲請再審及非常上訴，檢察總長也曾在2018年替羅明村提起非常上訴，無奈最後都被法院駁回。之後我們將會再次請求檢察總長為羅明村提起非常上訴，還他清白人生。</p>
<p>今年已經67歲的羅明村，還在監內期待平反日子的到來。</p>
<p>我們呼籲檢察總長提起非常上訴、最高法院撤銷違法判決。</p>
